Dodge/Burn Protect Tones - Preference for Off??

cs4 added "protect tones" dodge , burn tools little explanation does, yet default setting protect tones on. don't effect of protect tones.
is there way change default, short of creating tool preset?
tool preset defines brush shape , other settings. want ps launch protect tones check box off.

anyone?

missing filename after '-o'
